1. Introduction
These Terms & Conditions govern the use of the Alexandre Mason website and any enquiry submitted through it. By submitting an enquiry, you confirm that you have read, understood and accepted these Terms.
2. Our service
Alexandre Mason provides a private horse sourcing and selection service. We identify, evaluate and introduce sport horses, primarily from Portugal, to discerning clients around the world. Our role is advisory: we act as an intermediary between sellers and buyers and do not, as a rule, own the horses presented through our service.
3. Nature of an enquiry
Submission of the selection form, or any other contact made through this website, constitutes an enquiry only. In particular:
• An enquiry does not reserve any horse.
• An enquiry does not create a purchase agreement or any other binding contract.
• No payment is due at the enquiry stage.
Any reservation, option or purchase will be governed by a separate written agreement between the parties.
4. Availability and information about horses
All information about horses presented through our service, including descriptions, level of training, health status, photographs and videos, is provided in good faith and to the best of our knowledge at the time of presentation. Availability, condition and price may change at any time without prior notice. Horses may be sold, withdrawn from the market or have their training status updated between the moment information is presented and the moment a purchase agreement is signed.
5. Client information
You agree to provide accurate, complete and up-to-date information when submitting an enquiry. Misleading or inaccurate information may compromise our ability to identify suitable horses and may, at our discretion, result in the termination of the consultation.
6. Communication
By submitting an enquiry, you agree that Alexandre Mason may contact you using the contact details you have provided, in order to discuss your request, present suitable horses and coordinate next steps. You may ask us to stop contacting you at any time.
7. Prices, fees and purchase conditions
Indicative prices may be communicated as part of a presentation. Final prices, payment terms, veterinary examination conditions, transport, insurance and any additional fees are agreed separately between the parties and confirmed in a written purchase agreement. Until such an agreement is signed by all parties, no binding commitment exists.
8. Limitation of liability
Alexandre Mason provides its services with the highest level of care, but cannot guarantee the future performance, behaviour or health of any horse, nor the outcome of any transaction between a buyer and a seller. To the maximum extent permitted by law, our liability is limited to direct damages arising from a proven breach of our obligations under these Terms.
9. Intellectual property
All content on this website, including text, photographs, videos, graphics and the Alexandre Mason name and logo, is protected by intellectual property rights. It may not be reproduced, distributed or used for commercial purposes without our prior written consent.
10. Governing law
These Terms are governed by the laws of Portugal. Any dispute arising from their interpretation or execution shall be submitted to the competent courts of Portugal, without prejudice to mandatory consumer-protection rules that may apply in the client's country of residence.
11. Changes to these Terms
We may update these Terms from time to time. The version published on this page at the moment you submit an enquiry is the version that applies to that enquiry.
